FCI act para 12 (4) (a) – “FCI officers and other employees were allowed six months time to exercise option in writing to be governed (a) by the pay of scale applicable to the post held by him under the Government immediately before the date of transfer or by the scale of pay applicable to the post under the corporation which he is transferred”. In view of this, as per my opinion there may be two classes of pensioners (1) governed by CDA pattern DA (2) governed by IDA pattern DA as per option exercised by them at the time of transfer to FCI. As such there may be two different pattern for pension revision of FCI pensioners as per their option 1. CDA pattern with 2.57 fitment formula w. e. f 01.01.2016 (1 + 1.25 + 0.32) and 2. IDA pattern with 2.515 fitment formula (1 + 1.195 + 0.32).
We have seen one more report in circulation which says as under in brief.
1) The FCI Pension & Family Pension are brought under 7th CPC.2) Since implementation date for 7th CPC cannot be of different dates, the Revision is brought to the Unique date wef 01 Jan. 2016.3) Once brought under CPC, the D.A. Pattern also is to be Unique.Hence after revision of Pension under 7th CPC, IDA is terminated & CDA would be effective for the FDI Pensioners wef 01 Jan 2016.4) As such, after fixing the Pension wef 01 Jan 2016, under CPC the IDA Ceases and CDA takes effect at 0 %.5) As on 01 Jan 2016
An Illustration…
IDA Pattern Pension – Basic 30,000/- + IDA @ 112.4 % ₹ 33,720/ = Total 63,720/
After Revision under CPC, the Fixation – Basic as on 31 Dec 2015 – ₹ 30,000 X 2.57 = ₹ 77,100/
CDA 0 % – Total 77,100/
6) The orders are Silent about the Arrears..
Since it is in TOTO to 7th CPC, Arrears are to be paid at par with other C.G. Pension Revisions for FCI Pensioners..
Our View:
All 3 prayers of MTNL, BSNL, SNPWA to Pr.CAT were made for this date, under the assumption of 10 years from the previous revision viz. 01 Jan 2007.
If the above orders are also issued at par to BSNL / MTNL Pensioners, the effects would be the same.. and from that date IDA rates will not be applicable to BSNL/MTNL Pensioners and they will be governed by CDA rates. In future, BSNL/MTNL Pensioners will be goveraned by next C.P.C. Recommendations.
Let us hope that the DoT is not preferring appeal and tries to find out amicable way to implement PB CAT Order.
