Latest update on Pension Revision issue
As per reliable sources, Secy( T) is yet to take a final call on whether to go ahead with filing of appeal to challenge decision of PB CAT ND, as suggested by the Legal Advisor from ministry of Law or to go ahead with the implementation of the Judgment of PB CAT ND. The very fact that Secy( T) is yet to decide on filing of an appeal in Delhi High Court, as suggested by Law Ministry, even though the advice from Law Ministry is received about three months before, presumably leads one to believe that he Secy( T), may be considering the option of resolving the issue amicably
In the absence of Secy( T) not having yet decided which way to go, this Association does not want to take any preemptive action by filing contempt petition in CAT ND and thereby unnecessarily precipitate matters and thus give a chance to DOT Establishment to put the onus of prolonging legal battle and thereby scuttling an amicable resolution of the issue on us. That is why we are treading our future course of action with extreme caution.
Having said that, we are, however, at the same time, extremely vigilant on the issue and are maintaining a very close eye on how DOT is going ahead on the issue in the days to come. Accordingly, we are going to act. *
Our Comrades have to appreciate the predicament in which this Association is caught for understandable reasons
