Grant of Notional increment to the pensioners who retired after putting in one year of service.

On 21.01.2025, in CAT Chennai, Two contempt Petitions 12/2024 in OA O.A./391/2021 and 77/2024 in OA 285/2021 came up for hearing in CAT Chennai.

After hearing both sides the court has directed all the contemnors to be present personally in the court on 24/2/2025 and explain what is holding them back from honouring the SC judgment in applicability of the judgment dated 11.04.2023 in Civil Appeal N0.2471/2023, which has attained finality and the interim order of the SC on 06-09-2024 makes things further clearer.

Regarding superannuation cases, the court advised the respondents to act fast and issue orders at the earliest. Reg VRS cases, where two circles have issued speaking orders, the court observed that DoT and BSNL are hiding behind the carpet of the OA judgment claiming that VRS and Superannuation pensioners are not similarly placed. Though the court accepted our argument that VRS people have also completed 365 days of service, the court advised us to file fresh OA for VRS people, and the judge smilingly said, she would take care.

The Court was also informed that BSNL and DoT are dilly-dallying the genuine case and want to spend money from senior citizens. Moreover, some pensioners expired without seeing any benefits and filing OA is a time-consuming process. However, the court advised us to file a fresh OA for VRS pensioners and the rest of the things the court will take care of. For superannuation cases, the court gave apparent directions to implement court orders at the earliest to avoid further embarrassment

The respondents pleaded that notice may not be issued for the presence of contemnors, but the judge disagreed. For those who have retired or transferred, their incumbent will have to appear.

DOP&PW has since cleared the proposal to extend the be benefit to similarly placed officials of BSNL.
