STATUS OF PENSION REVISION IN DELHI HIGH COURT:

Before Hon’ble Justice Suresh Kumar Kait and Hon’ble Justice Girish Kathpalia at the Delhi High Court. The matters were mentioned by Mr. Kirtiman Singh, Counsel for the Petitioner/DOT and accordingly, taken up at 3:40 PM. Mr. Ankur Chhibber, instructed by Ms. Puri, appeared on behalf of the Respondents. Mr. Sanjoy Ghose, Senior Advocate appeared on behalf of the Respondents in Item 64.
Mr. Kirtiman Singh submitted that despite getting a higher pay scale, the Respondents herein, who are pensioners of BSNL and MINL, are seeking higher pension revision in terms of 7th CPC recommendations in parity with government employees, which they are not entitled to. Further, attention of the Court was drawn to Rule 37A of the CCS Pension Rules, 1972, wherein conditions for payment of pension on absorption consequent upon conversion of a government department in PSU were laid down and as per him, the pension was payable was as per the last pay drawn which in the present case is as per the 2nd PRC. Mr. Singh submitted that only the 2nd PRC recommendations have been implemented for the Respondents and not the 6th CP recommendations, and that the Respondents were being given pension as per IDA scheme. Mr. Chhibber and Mr. Ghosh apprised the Hon’ble Bench of sub-rule 8 along with the explanation and sub-rule 22 of the Rule 37A of the CCS Pension Rules, 1972. Mr. Chibber further pointed out Order dated 14.01.2002 issued by BSNL containing the terms for absorption to the Hon’ble Court and clarification dated 09.11.2000.
The Hon’ble Court kept the matter as a part heard matter for remaining submissions on 12.08.2024 at 3:15 PM.
